Insurance Times subscription terms

 

These terms apply to all subscriptions,  including any subscription arising from online or telephone orders, for Insurance Times and any related publications (“the magazine”) and the website at www.insurancetimes.co.uk  or any replacement website or domain, (“the website”). Your attention is especially drawn to the exclusions of liability in clause 6 below.

1.      Subscription contract

1.1    Your subscription will be fulfilled by Newsquest Specialist Media Limited, company number 02231405 with registered office at Loudwater Mill, Station Road, High Wycombe, Buckinghamshire, HP10 9TY (“we”, “us” or “our”), or our agents and sub-contractors.

1.2     When you post, fax, telephone or click ‘submit’ to make your order online you are making an offer to take out a subscription with us at the given price and, if we accept your offer, it will result in a legally binding contract.  Acceptance takes place and the contract is made on the date we send to you written confirmation of your order (which may be by post, fax or email). We will send such written confirmation within 14 days to the address details supplied by you.

1.3    All orders are subject to validation enquiries and receipt of payment or payment card authorisation. We reserve the right to refuse an order for any reason, or to cancel an order once accepted without further liability to you if: a) we do not receive within the specified time payment from you in cleared funds or payment authorisation from the issuer of your payment card; b) there has been a demonstrable error in advertised subscription rates (though we may fulfil your order at the correct price); or c) you have provided false information to us.  If your order is refused we will notify you and, if we have already received payment from you or debited your payment card, we will arrange for a refund.

1.4    Additional terms may relate to gift subscriptions. Ask our customer services staff.

1.5    A subscription is purchased for a subscription term and is not a guarantee of a defined number of issues. If the magazine changes frequency of publication we will only supply the number of issues falling within the term of the subscription.

2.      Delivery

2.1    We will deliver the magazine to the address you give us with your order. Unless we tell you otherwise, subscriptions will normally start from the next available issue following either: a) receipt of your payment or payment card authorisation, or b) written confirmation of your order, whichever is the later. If you have given us an incorrect address or failed to update your details, we will not be responsible and you will not be entitled to a refund for any issue which is late or not delivered.

2.2    In the case of a multi-user Corporate subscription, it is the responsibility of the main contact at the end user company to notify us of any changes to contact details or subscribers across the entire account. These details will then be updated accordingly. You agree that your subscription covers named users within your organisation and user login details will not be shared with other individuals. You are able to purchase and add additional named users to your Corporate subscription at any time.

2.3    You have the right to transfer a user of a multi-user Corporate subscription as necessary, however partial cancellations or refunds are not applicable in accordance with clause 5.1.

2.4    If you have purchased your subscription through a third party subscriptions agency, please contact the third party to update your details and they will contact us accordingly.

2.5    We will deliver the magazine within 3 working days of publication.  If a magazine fails to arrive, you must notify us within 3 working days. We will then post you a replacement copy. Should magazines fail to arrive for 3 consecutive weeks or more, we shall, at our option, do one of the following:  a) switch to an alternative method of delivery; or b) extend the subscription period free of charge for an equivalent period.

2.6    We will implement change of address details within 7 days of notification. You are responsible for giving us any change of details in sufficient time.

2.7    We will not be liable for any late or non-delivery of the magazine or website access if payment is not received in cleared funds or you card issuer has delayed or not authorised payment.

2.8    If any magazine is put on sale with a gift or supplement attached, whether as a covermount or otherwise, you may but are not guaranteed to receive such gift or supplement.

3.      Website access

3.1   Use of the website is subject to the website user terms, which are displayed on the website and form part of this contract.

3.2    As part of the checkout process we will ask you to register and create an account for our online services. Alternatively, if you purchase a subscription via email or phone we will email you a link/direct you to the registration page on the website to link your paid subscription to our online services.

3.3    If login details stop working at any time during the contract we will try our best to get online access reactivated within 48 hours of receiving notification from you.

3.4    Website access is restricted to you as a holder of a paid subscription only.  Unauthorised access or use by any other person is prohibited. You must keep your login details secure and confidential, including any user name and password (as they may change from time to time), and not disclose them to any other person. 

3.5   You will be in breach of this contract if you break the rules on website use or access and confidentiality of login details and we may at our option then terminate your subscription to the website without compensation.

3.6   The website will be available 24hrs per day and 7 days per week subject to any unexpected failure and suspension for routine or urgent maintenance work. If the website is unavailable for a period of more than 5 working days, upon written request from you (by email or post to customer services, see below) we shall extend the subscription for an equivalent period.

4.      Prices and payment

4.1    The applicable subscription packages and prices are advertised in the magazine and on the website and may be subject to increase from time to time. Subscriptions are given on a minimum 12 months initial term, unless otherwise agreed with us. Prices will include delivery charges, but not any applicable taxes, unless otherwise stated. The price you pay will be fixed if you make a one-off payment for a one or two-year subscription, otherwise price increases will be implemented when they arise.

4.2   If you are not using your own payment card or you are under 18, you must ask the permission of the payment card holder before giving payment details. By doing so, you are confirming that you have the express authorisation of the payment card holder.

4.3   If we invoice you for the subscription price, you must pay our invoice within 30 days of the date on which the invoice is issued.

5.       Cancellations

5.1    Cancellations are not permitted until the end of the minimum 12 month initial term, or any other fixed subscription term. 

5.2    We may also cancel in accordance with clause 1.3 above, or if the magazine or website ceases publication.

5.3    Recipients on a company or corporate subscription may be transferred during the subscription period.

5.4    We may terminate your subscription immediately without a refund if you breach any of the terms in these terms and conditions.

6.       Subscription offers

6.1    From time to time we will run subscription offers. These offers may be available to new subscribers only and this will be stated on the offer.

6.2    If an offer is available, customers must clearly state/quote the relevant priority code at the time of ordering in order to be eligible for the offer. We accept no liability for your failure to state/quote the relevant priority code.

6.3    Offers are subject to availability.

6.4    Where the offer has a closing date, we will not accept orders for the relevant offer after the stated date

7.      Our liability to you

7.1   The remedies for late or non-delivery are set out in clause 2.2 above or non-availability of the website in clause 3.5 above and cancellation provisions are set out in clause 5.  

7.2   But we shall not be liable  to you at all for late or non-delivery of the magazine or failure of website access or for any other delay or failure in connection with the contract between you and us  where such delay or failure is due to:

a) circumstances beyond our reasonable control or the reasonable control of our agents or sub-contractors, including but not limited to: act of God, governmental act, war, fire, flood, explosion, civil commotion, industrial dispute, failure of transport, utilities or telecommunications, or mechanical or computer breakdown (other than for want of maintenance by us); or

b) your own failure or delay in performing your obligations under the contract.

7.3   Except as otherwise provided in this clause 6 or elsewhere in these terms, we exclude all liability to you to the fullest extent permitted by law. For the avoidance of doubt , this exclusion does not apply to: a) any loss or damage  arising from death or personal injury caused by our negligence or that of our employees or agents;  and b) your statutory rights  as a consumer, which remain unaffected.

8.      Data protection

8.1   We comply with the Data Protection Act 2018 (DPA 2018). We will keep and use the personal information and payment details you supply to us to process your order and fulfil your subscription. We shall keep that information secure and confidential while it is in our hands, but you are responsible for its secure transmission to us. Please refer to our Privacy Policy for further details.

8.2   We may contact you in connection with the administration or renewal of your subscription using any of the details you provide to us.

8.3   In any order form or on the website we may ask you whether you want to receive from us or from third parties details of our or their products or services which may be of interest to you.  You are invited to tick the relevant boxes to signify whether or not you wish to receive such information.

9.      General

9.1   These terms may be varied by us from time to time.  It is the responsibility of subscribers to check for any changes in the terms on the website or by asking us for a copy.

9.2   A person who is not a party to the contract between you and us shall have no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce or rely upon any provision of such contract.

9.3   These terms supersede any other terms published by us in respect of any order you place with us.

9.4   These terms and the contract between you and us are governed by English law and subject to the exclusive jurisdiction of the English courts, notwithstanding that you may be in another jurisdiction.
