Beachcroft has commented on the decision by the Court of Appeal to reject a case for damages for alleged sexual abuse.
The court made its decision in Young v Catholic Care (Diocese of Leeds) and The Home Office on the basis that the claim was not made in the appropriate three year timescale.
Paula Jefferson, an injury risk partner at Beachcroft and a specialist in defending abuse claims, explained: “The requirement to bring a personal injury claim within the three or six-year periods is often challenging, as the claim will mostly be proceeding many years after the abuse occurred.
“There is a groundswell of opinion that there should be a radical overhaul of limitation in abuse and assault cases.”
