Fortis has lost its legal bid to force the British government to pay some of the compensation claims arising from the Selby rail crash in 2001, announced a report.
Fortis had been seeking a minimum contribution of £22.4m from the government. It has already paid out more than £22m relating to the accident.
Mr Justice Morland rejected Fortis' claim that the crash would not have happened if a safety barrier on a bridge over the railway line had been longer, said the report.
Fortis was the insurer for Gary Hart, the driver whose car came off a road into the path of a train after he fell asleep at the wheel. Ten people were killed and 70 injured in the crash.
