Lloyd's underwriters have been warned that the likelihood of software manufacturers being sued in product liability cases is increasing.

Law firm Elborne Mitchell said though it had in the past been difficult to sue software manufacturers for product defects, this position “may soon become unsustainable”.

Elborne Mitchell partner Jolyon Patten said: "Software houses have thus far been able to avoid product liability litigation. Nonetheless, it seems probable that the lawsuits will eventually come."

Patten added that, in the past 15 years, software defects had delayed the opening of the Denver airport for a year and destroyed two NASA Mars missions.
