Insurers have been urged by a leading commercial lawyer to resist the "temptation" to settle out of court during litigation.
Head of insurance at commercial law firm Hill Dickenson, David Scott, made the petition following his recent success on appeal in the case of a claim made by a woman who fractured her ankle after slipping in a restaurant.
Scott said: "The successful defence of this claim at the Court of Appeal injects some common sense back into Occupiers Liability Act cases particularly where the claimant should have taken greater care for her own safety.
"Too often we see cases where the claimant, and often courts, seem to require a far higher standard (than "reasonably safe", as required under the act) of the defendant and overlook the claimants own culpability."
