A new directive which could outlaw underwriters from using age or disability for pricing is likely to remain frozen until there is a change of German government, a European Commission spokesman said.

The spokesman said the EC would be discussing a progress update report today, but no action would be taken as the current German coalition Government has blocked the draft directive from moving towards implementation

But in an ominous sign for insurers, the spokesman said if the directive is eventually taken forward, it is unlikely to have an exemption clause for insurers in light of the recent gender discrimination ban.

The spokesman told insurancetimes.co.uk: “In the new directive there would be the same provision, but of course, we would need to look into it in light of the judgement, which means it’s probably not going to be possible to maintain the provision.

“Since the directive is stuck anyway, it doesn’t make sense to look at it now.”
