Fleet policyholders will not be fined if they made "reasonable efforts" to upload policy data on the Motor Insurance Database (MID) by the 19 January deadline.

The MID was created to help insurers and policyholders comply with the fourth EU Motor Directive which insists on documentation of insurance details.

The fourth EU Motor Directive came into force on 20 January.

The MID website has been experiencing technical difficulties so some policyholders have not yet uploaded their information. The Motor Insurers' Information Centre (MIIC) program manager Donald Martin said policyholders were liable to fines of up £5000 unless they had made reasonable efforts to get the information on the database.

"It is unlikely enforcement action will be taken, but policyholders must get the information through as soon as possible," said Martin.

He said there were in excess of 70% policies on the database already, but the MIIC was also giving people more time as the legislation came in so late on 19 January.

"A lot of fleet operators didn't do anything until they saw the legislation," he said.

Martin said the MIIC would be meeting the Department for Trade this week to discuss the legislation.

"There are a couple of differences in the legislation from what we anticipated," he said.

"One example is that the legislation requires policyholders to advise insurers immediately of any changes.

I think it needs some pragmatic work as some clauses are open to interpretation."

He said that the MIIC hoped to issue a guidance note to accompany the legislation by the end of the week.
