Passive smoking-related employers' liability (EL) claims look set to increase following a new campaign aimed at hospitality firms.

A letter outlining the legal position on passive smoking has been sent to 170 hospitality firms by health campaigning charity Action on Health and Smoking (ASH) and trade union law firm Thompsons.

John Hall, a solicitor at Thompsons, said that employers that failed to protect workers from the dangers of passive smoking should expect law suits from employees.

"This isn't an ambulance chasing exercise," Hall said. "But if employers continue to do nothing then they will leave themselves wide open to compensation claims."
