Career-ending tackle leads to action by Ashton and club

West Ham footballer Dean Ashton is bringing a case of "vicarious liability" against either the Football Association or Chelsea for the career-ending Shaun Wright-Philips tackle during an England training session in August 2006, The Guardian reports.

West Ham have also lodged a claim with the Football Association's insurers in order to claim their own compensation, after they paid Ashton a year's salary, thought to be around £3m.

Ashton was unable to claim on his own insurance as, having made a comeback, the terms of his new insurance policy precluded any cover for the injured ankle.

Insurance void

Ashton confirmed this earlier in the week when he told BBC Radio 5 Live: "There are a lot of things in your insurance where they don't have to pay you out. If you are injured when you renew it, they can obviously exclude your ankle. My insurance is void."

West Ham, the FA and Chelsea declined to comment.
