Underwriting agent Travel and Personal Underwriters (TPU) is claiming up to £150,000 from travel specialist Whiteley Insurance Consultants.

Whiteley, which operates under the brand name Kingfisher Insurance Services, was retained as a sub-agent of TPU, according to the claim form filed at the High Court.

Under the agreement Whiteley handled both the sale of travel policies, and claims adjusting and resolution arising from the schemes, as well as holding responsibility for the emergency medical assistance services provided by the policies.

TPU is claiming for declarations that Whiteley's sub-agency has expired, and is also seeking final injunctions or orders "restraining Whiteley from continuing to hold itself out as having authority to effect insurance policies under the expired schemes or purporting to do so".

According to the form, TPU is also claiming for the transferral of all claims files, and the claims float held for TPU's policyholders.

It is also seeking "an account of all premiums and claims arising under TPU business".

TPU managing director Mark Davidson said it would be "inappropriate" to comment on the proceedings.

Whiteley Insurance Consultants was unavailable for comment at the time of going to press.
