Zurich said its terms of business agreement (TOBA) would include the non-solicitation clause recommended in the joint ABI/Biba/IIB TOBA.

A Zurich spokeswoman said a draft form of the TOBA was currently with the IIB and Biba for comment, and would be released to the market shortly.

Market sources claimed that the TOBA contained a so-called 'Folgate clause', which would allow the insurer to approach customers directly in the event that the agency was cancelled.

Zurich said that the clause existed in an earlier draft but had since been changed.
