APIL and FOIL argue over personal injury costs reform

Association of Personal Injury Lawyers (APIL) president John McQuater and Forum of Insurance Lawyers (FOIL) president Anthony Hughes go head-to-head in the Times law section today on personal injury compensation costs.

McQater says: “Personal injury claims are about individuals and not just about process. But big business seems more at ease with an impersonal approach.

“So while we readily embrace genuine improvements, the Association of Personal Injury Lawyers is determined to ensure that the focus remains on the injured forced into seeking redress.”

Hughes says: “It is easy to portray personal injury litigation as a David v Goliath situation: an injured victim pitted against a faceless insurer, but to do so warps the true picture.

“Lord Justice Jackson has a tough task in making his recommendations but we are optimistic that he will find solutions that will promote access to justice at proportionate cost.
