Allianz Cornhill is seeking permission to appeal the Clark v Ardington decision in the House of Lords.
Technical claims manager Bob Rabbitts said: "Insurers are faced with some potentially worrying consequences, which we regard as being of public importance.
"Our actions need not stand in the way of our seeking an across-the-board-deal to amicably settle pre-ABI GTA (Association of British Insurers General Terms of Agreement) credit hire and repair claims."
