Noel Sullivan, the Welsh former fishmonger who became a member of chart-toppers Hear'Say, is suing Cardiff County Council for an accident four years ago, when he tripped over a drain cover in the city. He claims the incident restricted his mobility.
A council spokeswoman confirmed there was a case but said she was unable to say when it might reach court, because Sullivan has so far refused to be medically examined.
Miller Pycraft is handling the case for the council.
