Lawyers disappointed with judgement in the Administrative Court

A judicial review into the planned reduction of fixed recoverable costs has found in favour of the Secretary of State for Justice.

The Association of Personal Injury Lawyers (APIL) and the Motor Accident Solicitors Society (MASS) applied for the joint judicial review into the decision to cut fees for claims in the RTA Portal.

The Ministry of Justice (MoJ) intends to reduce recoverable costs for RTA claims under £10,000 to £500 from £1,200 in April this year.

The RTA portal is also to be extended in April to include claims of up to £25,000, as well as public and employer liability claims.

APIL described the result as “bitterly disappointing”. In a statement, the association said: “As the government has now decided to slash lawyers’ fees in the road traffic accident claims process, many people will be left on their own to negotiate with insurers for fair and proper compensation for their injuries.

“This is a dark day for people who are injured through no fault of their own. We can only hope that the government does not take this judgment as a license to continue to ride rough-shod over the needs of vulnerable people in the future.”
