The appropriate success fee recoverable in simple claims settled without court proceedings is 5% of the claimant lawyer costs, the Appeal Court has decided.
The court's ruling was given after it heard Thomas Halloran v James Francis Delaney last week.
It decided that the 5% should include the costs of any costs-only proceedings, unless the judge in the case was persuaded that a higher uplift was appropriate.
