I am writing in response to Helene Dancer's article "Baby claim row" (5 September, Insurance Times).
I look forward to hearing more about this case, because it affects not just this particular set of circumstances, but anyone who has a medical condition.
I wonder if the proposal form requested information on any medical condition, or if the proposed insured was pregnant?
In any event, this is surely a material fact and if disclosed with the appropriate details and no further questions by the agent, broker, or insurer, then cover would be provided.
