Pilot to become permanent if successful
The Road Traffic Accident Claims Portal Company has launched a behaviour committee pilot to mediate in disputes over the use of the portal.
Over the past year, a number of disputes have arisen between insurers and claimant lawyers, over the inappropriate use of Article 75, claims submitted without retainers, inappropriate use of interim settlement packs and extensions of time without prior agreement.
The pilot will run until 31 May 2011 and will be used where insurers and claimant lawyers are not able to resolve disputes. The pilot will become permanent if deemed a success.
The behaviour committee will provide general guidance on appropriate behaviour expected by users of the portal to assist in a resolution. However, the guidance provided by the committee is not binding.
The committee will be made up of a claimant and insurer representative and will meet on a monthly basis.
Any concerns over the use of the portal can be submitted using the behaviour report form available via the members’ area of the RTA Portal Co information site.
