John Spencer is normally quite correct on many issues but on this issue i am afraid he is way off - insurers have for a longtime let third party interceptors or claims management companies grab their claims - then they woke up and joined the race to garb the claims before lawyers and CMCs did - but recognising they were not geared up to run the cases efficiently they outsourced them to those that could - call it third party capture, call it what you want but the truth is they are beating CMCs at their own game and another unfortunate truth is they can do it a who;e lot cheaper than the current system - its difficult to argue against the rationale of the insurers on this - all you can try and do is work with them - it does not effect access to justice for those that are truly injured but it does deter those that believe a slight knock = £3000 - we are all guilty of the abuses of the current system but equally we are all able to update the current system and still commercially provide a service - standing still and maintaining the status quo has never been an option - those law firms and service providers who are nimble enough to embrace the change will be ok - those that dont will be a natural casualty of war I'm afraid
