Mesothelioma High Court case decision to be announced

The High Court’s Mr Justice Burton is today expected to rule on who should pay for long-tail mesothelioma cases brought about by exposure to asbestos.

Insurers have argued that the employer covering the worker at the time the cancer developed should be responsible, not the employer who exposed the worker to asbestos many years earlier.

Personal injury lawyers and trade unions have argued that by the time the cancer takes hold the employer had often gone out of business and the insurer of the employer who exposed the worker to asbestos should pay.

Mr Justice Burton is expected today to rule on the nine-week court case in the summer.

The 2025 Insurance Times Awards took place on the evening of Wednesday 3rd December in the iconic Great Room of London’s Grosvenor House.
