Marsh & McLennan has agreed to hand over subpoenaed documents relating to charges that it conspired with commercial casualty insurers to eliminate competition, misled customers, and inflated premiums paid by policyholders in Ohio.
Attorney general Marc Dann stated that the decision to hand over the documents brings to an end “years of delaying tactics and legal manoeuvring”.
According to Dann, Marsh signed a stipulated order that calls for the company to immediately produce 614 boxes of documents they have already compiled, sets an 30 April deadline for the production of all other materials his office is seeking, and gives the attorney general's office the right to depose the company's custodian of records to determine if the company maintains records in a way the existing subpoena would not capture.
“While I am pleased the company's decision to finally comply with our lawful subpoena will enable us to continue our investigation, we will be watching very carefully to see if Marsh continues to cooperate or reverts to the type of behaviour that has impeded our efforts over the past two years,” Dann said.
